Party A and B have reached an agreement through friendly consultation to conclude the following contract.
(1). Location of the premises
Party A will lease to Party B the premises and attached facilities owned by itself, which is located at_Room XXX,XXX mansion, XXX County. The size is around XXX square meter, the facilities in the room include: a electronic water heater, a Kitchen Ventilator, a gas cooker and three air-conditioning(will be installed in 2 days after pay the rent).
(2). Lease term
The lease term will be from 08/15/2008(mm-dd-yyyy) to 8-15-2009(mm-dd-yyyy). The rental will be XXXXRMB/month. Payment of rental will be one time every 6 months. After the lease term due, part B should have the priority in the following lease.
(3).other fee
During the lease, part B should pay the monthly fee for the room to the corresponding department, which include: water, electric, cable video, building cleaning,(electric power____, water_____)
(4). Deposit
Guarantying the safety and good conditions of the premises and attached facilities and account of relevant fees are settled on schedule during the lease term, party B will pay________XXXXRMB_________ to party A as a deposit.
(5). Party A guarantee that the house is his legal propriety, and will Commitment from the responsibility of property rights disputes.
(6). Party B ensure the residential housing for legitimate use only during the lease period, not to violate the law and discipline, not to change the structure of housing, do not sublet to others. Party A responsible the normal maintenance of housing to ensure Party B normal use. If Party B inappropriate use or other man-made factors that result in housing structural damage, Party B is responsible for granting compensation or rehabilitation.
(7). During the lease period, Party B should be law-abiding, attention to public health, good to neighbors, and promptly to the local police station for a temporary account, Party B should take all the responsibility for the result of disputes or offences.
(8). While Party A need take back the house or Party B need quit the lease, must inform the other party one month in advance or should pay penalty to other party, the penalty standard for breach of contract is 2,000 RMB. The two sides agreed that both of the two sides may not quit lease contract during the lease period.
(9). While Party B didn't pay the rent within the specified period (one month in advance), the Party A can confiscate the deposit and termination of the lease.
(10). Both party A and B should strictly abide this agreement, either party violate each other and cause losses must responsibility to pay compensation. losses should be based on the fact amount.
(11). During the rent, the tenant should strictly abide to these treaties, if the tenant does not return the key or pay the rent when the lease period expire,Party A have the right to deal the house by own.
(12). There are 2 originals of this contract. Each party will hold 1 original. It goes into force on the date when the two sides signed, the remaining issues resolved by consultation between the two sides.
Notes: on this contract signed day, Party B pay 2,000RMB to Party A as rent deposit, if the Party B have not yet paid the remainder of the rent before September 1, 2008, Party B agreed Party A to rent this room to another person and confiscate Party B's deposit as the penalty.
